Released records show negotiations in HITW suits

The Mathews County Board of Supervisors released records last week regarding its negotiations to try to settle matters with Hole in the Wall Waterfront Grill, which has pending litigation against the county and two of its supervisors.
The action came after supervisor Dave Jones, speaking during the board’s June meeting, stated that there were “FOIA-able” communications about the matter between supervisor Tom Bowen and restaurant owner Mac Casale, and this newspaper submitted a Freedom of Information Act request for those communications.
The released records show that, as the board’s designated negotiator, Bowen presented Casale with a proposed memorandum of understanding that suggested working toward a resolution of all outstanding issues between the county and the restaurant, solving the building and septic issues on the county-owned property, and ultimately dismissing all lawsuits between the parties.
