George Jones, David Jones and JB Property Development, all of Mathews, filed a motion in Mathews Circuit Court on Oct. 25 to nonsuit an action taken in February of 2020 against Mathews County and the county’s former planning and zoning director, Thomas Jenkins.
Judge Jeffrey W. Shaw granted the motion on Nov. 1 and ordered that the case be dismissed “without prejudice as to defendants.” A dismissal without prejudice means that the court did not decide on the merits of the case, and that the plaintiff may file the suit again.
The Mathews County Board of Supervisors held a closed session during its Oct. 25 board meeting to consult with legal counsel and receive briefings by staff pertaining to the litigation in both the case of JB Property LLC vs Mathews County and a related case, Mathews County vs JB Property LLC.
