The Mathews County Board of Supervisors has dropped its August 2023 suit in Mathews Circuit Court requesting that the judge reverse a decision made by the Mathews Board of Zoning Appeals.
The suit was filed in response to the BZA’s finding in July 2023 that the county-owned Hole in the Wall Restaurant on Gwynn’s Island had not violated the county zoning ordinance regarding an addition on the east side of the existing building and expansion of a previously permitted deck. The board of supervisors that was sitting at that time disagreed with the finding and filed suit.
Subsequently, Hole in the Wall filed suit against the county and two supervisors who were on the board at that time and who currently remain on the board, Dave Jones and Mike Walls. The suit alleged malicious prosecution and abuse of process. That suit has been non-suited, which means it is inactive but can be brought forward again.
