Jones, Walls file response to HITW suit

Mathews supervisors Dave Jones and Mike Walls have filed a response to a lawsuit brought against them and the County of Mathews by Hole in the Wall Waterfront Grill.
Hole in the Wall, owned by Mac Casale and Dean Tsamouras, filed suit against the county and the two supervisors in November, charging malicious prosecution and abuse of process and seeking $10 million in compensatory damages plus $350,000 per defendant for punitive damages.
The suit cited “combined efforts in initiating and bringing zoning proceedings and threatening civil claims against plaintiff for spurious zoning violations.” It also alleged that the actions of the board of supervisors and Jones and Walls “constituted a complete disregard of plaintiff’s rights, were done with actual malice, and were not based in fact.”
In their response, a demurrer, Jones and Walls, represented by Babcock Moore & Lambert PLC of Virginia Beach, state that HITW’s complaint “fails to state a claim upon which relief may be granted.” It...
