Eubanks appeal case to state Supreme Court

Candy and Mark Eubank of Doswell and Gwynn’s Island have submitted an appeal to the Supreme Court of Virginia in their case against Mathews County Administrator Mindy Conner and the county’s former wetlands administrator Sue Thomas and planning and zoning director John Shaw.
In the appeal, filed in Mathews County Circuit Court on Monday, March 30, the Eubanks state that a transcript of the facts, testimony and other incidents of the case has been requested from the court reporter and will be filed.
The matter was heard on Feb. 28 by retired Mathews Circuit Court Judge William H. Shaw III, who dismissed the case with prejudice.
The suit, originally filed in May 2018, nonsuited in April 2019 and refiled in October 2019, accused the county employees of malice in the issuance in 2015 of summonses against the Eubanks, who had failed to take corrective action or file an appeal after having been charged with violations of the zoning ordinance.
