A court case regarding zoning violations at Tin Can Alley on Gwynn’s Island that’s been lingering in Mathews Circuit Court for years has finally been set for trial.
Candy and Mark Eubank vs Sue K. Thomas, Mindy Moran Connor and John Shaw, a suit first filed in May 2018, has been scheduled to be heard before a jury on April 24, 25 and 26, 2025 in Middlesex County Circuit Court.
In the order setting the date, the court encouraged the two sides to participate in a settlement conference, stating that, because the parties had already participated in one settlement conference, they are not required to do so again.
The case involves complaints the Eubanks had against three former Mathews County employees regarding a notice of zoning violation the county issued against the couple in 2015. The notice stated they were in violation of the zoning ordinance at their waterfront property on Gwynn’s Island because of structures built without a permit and unpermitted expansions into buffer zones.
