Charges of assault and battery, disorderly conduct, and abusive language filed against Mathews County supervisor Mike Walls by board of supervisors’ candidate Billy Cook were scheduled to be heard on Monday but were instead continued by Judge Joshua P. DeFord of the 9th Judicial District.
According to Commonwealth’s Attorney Nate Green of James City County/Williamsburg, who was appointed by Judge Jeffrey W. Shaw in May as special prosecutor for the case, the two parties had reached an agreement on the case, so Green dismissed the witnesses. After the witnesses had been dismissed, Walls changed his mind on the agreement, said Green, so the case had to be continued.
The case will now be heard at 1 p.m. on Monday, Oct. 23, in Mathews General District Court. DeFord also continued a protective order that had been issued against Walls to that date.
